Practicing successfully in appellate courts involves different procedural rules, different skills and a different perspective. No one can explain that better than Justice Robert A. Spolzino, who retired from the Appellate Division, Second Department, in 2009, after hearing and deciding more than 4,400 appeals. Since leaving the bench, he has argued seven times in the Court of Appeals and together with his team at Abrams Fensterman has argued well over 100 times in the Appellate Division. Justice Spolzino will discuss the technical and procedural issues that are unique to appellate practice, such as appellate jurisdiction, appealability, reviewability and obtaining immediate relief pending appeal, as well as the strategic issues that can enhance your chances of prevailing, including preserving issues effectively in the trial or motion court, structuring your appellate brief for success and arguing effectively.
