The Governor has signed into law legislation that will require nursing homes to revise their pandemic emergency plans to include:

  • A plan to designate a separate cohort area during an outbreak within the facility, to permit the separation of residents that are suspected of being infection. The plan must include the designation of an infectious disease care unit.
  • Notifications to all residents, authorized family members and guardians of residents within 12 hours of the detection of an infection of a resident or staff member. Such notifications may be via email, or other means as selected by the recipient.

 

The law will go into effect on February 5, 2023.

The Department of Health may issue regulations, or further guidance, regarding the implementation of these new pandemic emergency plan mandates.
