In a recent ruling, the Supreme Court of New York, led by Justice Reginald A. Boddie, sided with Abrams Fensterman’s client in its case against several defendants involved in the construction of a building in Brooklyn. The court denied the defendants’ motion to dismiss, finding that they had waived the arbitration requirement in the construction contract.

 

Abrams Fensterman Associate, Sabrina DiStefano, effectively crafted a winning argument to support the Plaintiff’s position that Defendants had waived the arbitration requirement in the construction contract. The court agreed, noting that the defendants had stipulated to restore this case to the Court’s active calendar and had participated in a Preliminary Conference setting a discovery schedule. Such actions were inconsistent with the intent to pursue arbitration.
