Previously published in the March 2025 edition of Roslyn Living

In our close-knit Roslyn community, the challenges of caring for aging loved ones often weigh heavily on families. Questions about managing finances, medical decisions, or protecting vulnerable individuals can arise suddenly, leaving families feeling overwhelmed. That’s where Roslyn resident Danielle M. Visvader steps in, offering her experience as a Partner in Abrams Fensterman’s Guardianship Practice Group.

Danielle focuses on Guardianship Law, guiding families through the complex process of securing the right care and protection for loved ones under New York’s Article 81 of the Guardianship Statute. On average, Danielle handles over 100 guardianship cases each year, making her one of the most trusted voices in the field.

UNDERSTANDING GUARDIANSHIP LAW

Guardianship is designed to protect those unable to manage their personal or financial affairs. Whether due to dementia, a brain injury, or other functional limitations, guardianship proceedings ensure that the right decisions are made in the best interests of the individual, known as the Alleged Incapacitated Person. Danielle explains, “Guardianship is a remedy of last resort, but when it’s necessary, it can bring peace of mind and security to families in difficult situations.”

Danielle’s experience spans all facets of guardianship, from initiating proceedings to addressing disputes over guardianship appointments. A recent case highlights her ability to reunite an ailing father with his sons after an abusive relationship led to financial exploitation and isolation. Her work restored stability and dignity to his life—a testament to her dedication to justice and compassion.

WHY ABRAMS FENSTERMAN

Abrams Fensterman, with its Long Island roots, has earned a reputation as the go-to law firm for guardianship matters. Recognizing guardianship issues can be difficult for the average person. At your next dinner party or family function, some buzz words that could indicate a guardianship issue are:

  • elderly parents;
  • dementia, stroke, brain injury;
  • they never did any planning – no Power of Attorney;
  • my sister/brother takes care of them but won’t let me see them;
  • my sister/brother doesn’t share information with me;
  • they need home health care but refuse to let anyone in the house;
  • my mom/dad remarried – we think he/she’s in it for the money;
  • they have a home health aide – we don’t know how she is paid or who pays her;
  • my sister/brother took my parents to an attorney;
  • my mom/dad just went into a nursing home, and we need to look into Medicaid benefits;

ROSLYN ROOTS AND COMMUNITY CONNECTION

Danielle’s ties to Roslyn aren’t just professional—they’re personal. She is an active member in the Roslyn community and is often seen at Harbor Hill School or Roslyn Middle School for one of her three children, Zachary, Olivia, and Jake. She is a member of the Sid Jacobson JCC, where her children attended nursery school.

As a proud resident of Roslyn, Danielle understands the unique needs of families in our area. Danielle and her late husband, Joe, chose Roslyn to raise their family because of its reputation as a close-knit and family-oriented community.

“Living in Roslyn gives me a deep appreciation for the special family relationships that define our community,” she shares. “I’m inspired to help my neighbors navigate these challenging and very personal legal issues, ensuring that their loved ones receive the care they deserve and that their assets are protected.”

Together, let’s ensure that every member of our Roslyn community is cared for and protected.
