On August 25, 2020, the Centers for Medicare & Medicaid Services (“CMS”) issued an Interim Final Rule that revises the regulations for long term care facilities and other providers. This rule establishes new requirements for COVID-19 testing of staff and residents at long term care facilities.

 

The regulations are effective immediately upon there publication at the Office of the Federal Register. CMS did not establish a specific frequency for COVID-19 testing in the rule, but listed potential criteria that may be contemplated and addressed once the regulations are published.
