Yesterday, Governor Cuomo held a press conference to discuss the inflating COVID positivity rate.

 

While he acknowledged that the State does not have the authority to mandate it at this time, he recommended that all businesses require employees (and patrons) to be vaccinated. Note that the EEOC has already said that it is legal for employers to mandate its employees be vaccinated (there are some limitations).

 

He also said that local governments do have the power to act, and urged them to re-implement public mask mandates. New York City is among the localities discussing the return of mask laws. NYC’s positivity rate is lower than either Nassau or Suffolk’s.
