Updates to Nursing Home Residents’ Rights
The New York State Department of Health (“DOH”) issued new guidance today, updating certain requirements related to the nursing home residents’ rights.
Specifically, the guidance implements recently enacted legislation that requires nursing homes to post and make available:
- The residents’ bill of rights, translated into the ten most common non-English languages spoken in New York; and
- Contact information for the state and regional offices of long-term care ombudsman program, and DOH’s nursing home complaint hotline.
Nursing homes are also directed to provide residents with DOH’s legal and resident advocacy services guide before and upon admission, and also on request.
Lastly, the guidance makes available a template discharge notice, that nursing homes may choose to use when complying with regulations that require certain information be provided to residents prior to a discharge or transfer. The template is also available in the ten most common non-English languages spoken in New York.
