You may no longer rely on a job applicant’s compensation history in setting or offering compensation.
YOU CANNOT
- Ask about an applicant’s prior or current salary
- Ask about an applicant’s benefits or other compensation history
YOU CAN
- Ask about an applicant’s expectations regarding salary, benefits, and other compensation
- Inform an applicant about the position’s proposed or anticipated salary range
If an applicant volunteers their history without prompting, you may verify the information.
Employers can also inquire about compensation history if a federal, state or local law authorizes the inquiry.
All employers need to adopt a practice and train employees.
