CLIENT ALERT: NEW YORK CITY HUMAN RESOURCES ADMINISTRATION MEDICAID UPDATES

 

On January 24, 2013 the New York City Human Resources Administration (“HRA”) issued a Medicaid Alert that made two changes to the disability review process. The changes concern the disability review forms and HIPAA releases.

 

DISABILITY REVIEW FORMS:

 

As of February 28, 2013 HRA will only accept versions of the disability review documents dated June 2012 and after. This rule applies to the two disability forms commonly referred to by their form numbers – LDSS-1151 and LDSS-486T .

 

PRACTICE TIP: The date a Medicaid form has been revised is located in the upper left hand corner of the form.

 

HIPAA RELEASES:

 

Also as of February 28, 2013 Medicaid applicants and their representatives are asked to include three (3) signed and dated HIPAA releases (available HERE) with every disability review packet. The HIPAA releases are intended to assist HRA in securing the applicants’ medical records directly from providers.

 

PRACTICE TIP: While submitting HIPAA releases is not yet mandatory, a failure to return these forms could negatively influence the outcome at a Fair Hearing. We therefore strongly recommend that HIPAA releases be completed whenever a competent resident, or a resident’s power-of-attorney or Guardian, is willing and able to sign the forms.
