The discussion focused on the Federal Trade Commission’s (FTC) upcoming ban on noncompete agreements and its impact on businesses in New York.
During the webinar, Gold highlighted New York’s increasingly narrow interpretation of non-competes, noting that very few are upheld in state courts. She emphasized the four critical factors courts consider: necessity, employee hardship, public harm, and reasonableness in scope and duration.
