The Long Island Business News reported on the FTC webinar that Abrams Fensterman Partner & Director of Employment Law, Rachel Demarest Gold, participated in along with other panelists, Kenneth A. Novikoff of Rivkin Radler and Joseph Milizio of Vishnick McGovern Milizio. The webinar was moderated by LIBN Editor, Regina Jankowski. The discussion focused on the Federal Trade Commission’s (FTC) upcoming ban on noncompete agreements and its impact on businesses in New York.

 

During the webinar, Gold highlighted New York’s increasingly narrow interpretation of non-competes, noting that very few are upheld in state courts. She emphasized the four critical factors courts consider: necessity, employee hardship, public harm, and reasonableness in scope and duration.
