Abrams Fensterman, led by Attorneys from the White Plains office, including David Imamura, Robert Spolzino, Edward Smith, and Anthony Genovesi, successfully defended their client, The City of Yonkers, in a lawsuit challenging the cities fire department’s inspection fees.

 

Westfair Business Journal reported on the win stating “A Westchester Supreme Court judge has dismissed a 2017 lawsuit where two Yonkers landlords claimed that the fire department was using inspection fees for work other than a fire and building safety inspection program.”

 

Two landlords challenged the city, claiming inspection fees were improperly used for “work other than a fire and building safety inspection program.” However, Judge Giacomo ruled that the landlords “only speculate” about the fees’ use and “failed to prove beyond a reasonable doubt that there were missed inspections,” resulting in a victory for the city.
